These Terms and Conditions govern the use of the website z3nith.io and the relationship between Z3NITH, SOCIEDAD POR ACCIONES SIMPLIFICADA DE CAPITAL VARIABLE (Z3NITH, S.A.S. DE C.V.), trading under the Z3NITH brand, and the individuals or companies that access the site, request information or contract its services.

By using the site, submitting a form or contracting a service, the user or client declares that they have read and accepted these terms, as well as the Legal Notice and the Privacy & Cookies Policy.

Z3NITH provides artificial intelligence agents, process automation, integrations, custom software development, strategic AI consulting and data analysis services. The specific scope of each service is defined in the corresponding proposal, quote or contract agreed with each client.

The information published on the site (plans, prices and descriptions) is indicative and may vary depending on the needs and scope of each project.

The prices shown on the site are indicative, are expressed in United States dollars (USD) and include VAT where so indicated. The final price, payment terms and conditions of each service are set out in the proposal or contract accepted by the client.

Recurring services (such as monthly plans) are invoiced periodically as agreed. Custom development and projects are quoted according to their scope.

The client undertakes to provide truthful, complete and up-to-date information; to hold the necessary authorizations over the data and content it delivers or connects to the systems; to protect its credentials, accounts and access; and to use the services in accordance with the law and with the policies of the third-party platforms involved.

The client is responsible for reviewing and approving workflows, agents or integrations before they go into production, as well as for the use its team makes of the delivered solutions.

The brand, the site, the methodology, the templates, the base code and Z3NITH’s own materials belong to Z3NITH. Unless expressly agreed otherwise, the delivery of a project grants the client a license to use the developed solution for its own purposes, without transferring ownership of Z3NITH’s components, tools or know-how.

Both parties will treat as confidential the non-public information exchanged during the commercial relationship, using it solely for the provision of the service and limiting access to those people who reasonably need to know it.

Z3NITH services may depend on external platforms such as Meta, WhatsApp, Google, artificial intelligence providers, hosting, CRMs, APIs and automation tools. Z3NITH does not control changes in pricing, rules, availability, limits, blocks or decisions made by those providers, nor will it be liable for interruptions or impacts directly attributable to them.

Z3NITH applies reasonable and professional measures in the provision of its services, but does not guarantee that the systems, agents, automations or integrations will operate uninterrupted, error-free or immune to incidents beyond its control.

To the extent permitted by law, Z3NITH will not be liable for indirect damages, loss of profit or losses arising from inaccurate client information, misuse of the solutions, third-party failures, force majeure or modifications made without its authorization. This limitation does not exclude liabilities that cannot legally be limited.

The term, renewal and cancellation conditions of each service are set out in the corresponding proposal or contract. Failure to pay for a recurring service may suspend or terminate its provision, following reasonable notice.

Z3NITH may update these Terms and Conditions to reflect legal, technical or operational changes. The version in force will be published at z3nith.io together with its last update date.

These terms are governed by the laws of the Republic of El Salvador. Any dispute will be submitted to the competent courts of El Salvador, unless applicable regulations provide otherwise.
